The state is an institution established by people. It is to ensure that the person who is the object of its existence of religion and world life in a system. In this sense, the state can provide a set of legal rules for people's daily lives to flow in an order. The rules which provided by the state relate to a direction concerning an aspect of the individual's life. In other words, the rules laws that make by the state are related to one of the provisions in any case. Therefore, it is important for the state to save on the shar'i provisions and bindingness these savings in terms of the individual. At our study, this issue goes around in accordance with the opinions of the Shafi'i jurists.
