The prisons used to complete time passing until execution have also undertaken such functions as to punishing criminal or gaining community in the Ottoman legal system, especially since the second half of the nineteenth century. The major change concerning the legal theory and practice has not been encountered in the Ottoman Empire until the Tanzimat. As a matter of fact, the judicial reform that was taken place after 1840 brought new regulations to the Ottoman courts. This laid the groundwork for the formation of European style prisons. With II. Abdulhamit, prison reform had become increasingly important. In this context, the principle that prison will be found in every town, sanjak and provincial centers in the Prison Regulations published in 1880 is evident. One of the places where was built with the transition to the prison system is Mu? sanjak which is connected to the Bitlis province. While there is no clear knowledge of when prison was originally made in Mus, to be mentioned of the need for a new prison at the beginning of the 20th century, points out the presence of a prison even small before this date. Indeed, Indeed, the physical condition of the building was rather inadequate at the beginning of the 20th century. The bad situation that the prisoner was in had caused the spread of many diseases, especially security problems like desertion. For this reason, the prison which was repaired from time to time was rebuilt after the repair was inadequate.
